Definitions

For the purposes of these Terms & Conditions, the following terms shall have the meanings set out below unless the context requires otherwise:

“Company”, “SeaGo”, “we”, “our”, or “us” means SeaGo IT Support Services – FZCO and its affiliates, successors, and permitted assigns.

“Platform” means the SeaGo Maritime website, mobile application, software, systems, databases, cloud storage functionality, content, communication tools, subscription services, and related services operated or made available by SeaGo.

“User” means any individual or entity accessing, browsing, registering with, or otherwise using the Platform, including seafarers, maritime professionals, employers, recruiters, shipping companies, or other business users.

“User Content” means any information, data, text, documents, certificates, licenses, medical records, identity documents, photographs, communications, job postings, employment history, profile information, or other content uploaded or transmitted through the Platform.

“Subscription Services” means any paid services, premium features, memberships, subscriptions, or paid access functionality made available through the Platform.

1. Introduction and Acceptance of Terms

These Terms & Conditions (“Terms”) govern access to and use of the SeaGo Maritime platform, including the website, mobile application, and related services (collectively, the “Platform”), operated by SeaGo IT Support Services – FZCO.

By accessing, registering with, or using the Platform, users acknowledge that they have read, understood, and agreed to be bound by these Terms and the Privacy Policy.

If a user does not agree with these Terms, such user must immediately discontinue use of the Platform.

The Platform is intended for users within the maritime and related industries, including seafarers, employers, maritime professionals, and business users.

2. Platform Role and Nature of Services

SeaGo operates solely as a technology platform and communication infrastructure that enables users to create profiles, upload documents and information, post opportunities, and communicate with one another.

Users acknowledge that SeaGo merely provides digital infrastructure and does not participate in employment negotiations, hiring decisions, or contractual arrangements between users.

3. User Accounts and Eligibility

Users may be required to create an account in order to access certain Platform features.

SeaGo reserves the right to suspend, restrict, or terminate accounts where misleading, unlawful, fraudulent, abusive, or suspicious activity is identified.

4. User Content and Document Uploads

The Platform may allow users to upload, store, share, or transmit User Content, including sensitive personal information.

Where users upload sensitive personal data, including medical records, identity documents, or confidential certifications, users expressly consent to the collection, processing, storage, and use of such information in accordance with the Privacy Policy and applicable law.

SeaGo reserves the right to remove, restrict, suspend, or review User Content where reasonably necessary for operational, legal, security, or compliance purposes.

5. Verification Disclaimer

SeaGo does not independently verify users, profiles, certifications, licenses, employment history, medical records, identity documents, job postings, or other User Content.

Users acknowledge that:

Companies are solely responsible for conducting their own due diligence, verification, and background checks before engaging with candidates.

Likewise, seafarers and users are solely responsible for independently assessing employers, opportunities, and communications available through the Platform.

The Platform enables users to communicate and interact directly with one another.

Users agree to use the Platform only for lawful purposes and in accordance with these Terms.

8. Subscription, Billing, and Payment Terms

Certain Platform features may be offered on a paid subscription basis.

Where subscriptions are purchased through Apple App Store or Google Play, billing, renewals, cancellations, and refunds may also be subject to the applicable policies of those platforms.

9. Limitation of Liability and Disclaimers

To the maximum extent permitted by law, the Platform and services are provided on an “as is” and “as available” basis without warranties of any kind.

Users acknowledge that use of the Platform and interaction with other users occurs entirely at their own risk.

10. Suspension and Termination

SeaGo reserves the right to suspend, restrict, or terminate access to the Platform where:

11. Intellectual Property Rights

All intellectual property rights relating to the Platform, including software, branding, logos, databases, design, and content, are owned by or licensed to SeaGo.

Users retain ownership of User Content but grant SeaGo a non-exclusive license to host, process, store, reproduce, and use such content solely for operation and improvement of the Platform.

12. Privacy and Data Protection

SeaGo processes personal data in accordance with the Privacy Policy and applicable data protection laws, including relevant UAE laws and, where applicable, GDPR principles.

Users acknowledge that sensitive personal data voluntarily uploaded through the Platform may be processed and stored in accordance with the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

The courts of Dubai, United Arab Emirates shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or use of the Platform.

14. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between SeaGo and users relating to use of the Platform.
