Definitions

For the purposes of these Terms & Conditions, the following terms shall have the meanings set out below unless the context requires otherwise:

“Company”, “SeaGo”, “we”, “our”, or “us” means SeaGo IT Support Services – FZCO and its affiliates, successors, and permitted assigns.

“Platform” means the SeaGo Maritime website, mobile application, software, systems, databases, cloud storage functionality, content, communication tools, subscription services, and related services operated or made available by SeaGo.

“User” means any individual or entity accessing, browsing, registering with, or otherwise using the Platform, including seafarers, maritime professionals, employers, recruiters, shipping companies, or other business users.

“User Content” means any information, data, text, documents, certificates, licenses, medical records, identity documents, photographs, communications, job postings, employment history, profile information, or other content uploaded or transmitted through the Platform.

“Subscription Services” means any paid services, premium features, memberships, subscriptions, or paid access functionality made available through the Platform.

1. Introduction and Acceptance of Terms

These Terms & Conditions (“Terms”) govern access to and use of the SeaGo Maritime platform, including the website, mobile application, and related services (collectively, the “Platform”), operated by SeaGo IT Support Services – FZCO.

By accessing, registering with, or using the Platform, users acknowledge that they have read, understood, and agreed to be bound by these Terms and the Privacy Policy.

If a user does not agree with these Terms, such user must immediately discontinue use of the Platform.

The Platform is intended for users within the maritime and related industries, including seafarers, employers, maritime professionals, and business users.

2. Platform Role and Nature of Services

SeaGo operates solely as a technology platform and communication infrastructure that enables users to create profiles, upload documents and information, post opportunities, and communicate with one another.

SeaGo does not operate as:

• a recruitment agency;
• a crewing agency;
• an employer;
• a staffing provider; or
• an employment intermediary.

SeaGo does not independently verify or authenticate:

• user identities;
• employment history;
• qualifications or certifications;
• medical records;
• passports or identity documents;
• visas or immigration documentation;
• job postings; or
• user representations.

Users acknowledge that SeaGo merely provides digital infrastructure and does not participate in employment negotiations, hiring decisions, or contractual arrangements between users.

3. User Accounts and Eligibility

Users may be required to create an account in order to access certain Platform features.

By creating an account, users represent and warrant that:

• all information provided is accurate, current, and complete;
• they have authority to upload and share User Content;
• they are legally capable of entering into binding agreements; and
• they are at least 18 years of age.

Users are solely responsible for:

• maintaining confidentiality of account credentials;
• restricting unauthorized access to accounts; and
• all activities conducted through their accounts.

SeaGo reserves the right to suspend, restrict, or terminate accounts where misleading, unlawful, fraudulent, abusive, or suspicious activity is identified.

4. User Content and Document Uploads

The Platform may allow users to upload, store, share, or transmit User Content, including sensitive personal information.

Users acknowledge and agree that:

• all User Content is uploaded voluntarily and at the user’s own responsibility;
• users are solely responsible for legality, authenticity, validity, ownership, and reliability of User Content;
• users must ensure that uploaded documents do not violate applicable laws or third-party rights.

Users must not upload:

• false or misleading information;
• unlawful or fraudulent content;
• malicious software or harmful files;
• content infringing intellectual property or privacy rights.

Where users upload sensitive personal data, including medical records, identity documents, or confidential certifications, users expressly consent to the collection, processing, storage, and use of such information in accordance with the Privacy Policy and applicable law.

SeaGo reserves the right to remove, restrict, suspend, or review User Content where reasonably necessary for operational, legal, security, or compliance purposes.

5. Verification Disclaimer

SeaGo does not independently verify users, profiles, certifications, licenses, employment history, medical records, identity documents, job postings, or other User Content.

Users acknowledge that:

• information available through the Platform may be inaccurate, incomplete, outdated, misleading, or unauthorized; and
• reliance on User Content or user interactions is entirely at the user’s own risk.

Companies are solely responsible for conducting their own due diligence, verification, and background checks before engaging with candidates.

Likewise, seafarers and users are solely responsible for independently assessing employers, opportunities, and communications available through the Platform.

SeaGo shall not be liable for:

• false or misleading information;
• fraudulent activity;
• invalid certifications or documentation;
• employment decisions or outcomes;
• disputes arising between users.

6. Employment and User Interaction Disclaimer

The Platform enables users to communicate and interact directly with one another.

SeaGo is not:

• an employer;
• a recruitment or crewing agency;
• a representative or agent of any user; or
• a party to employment or commercial arrangements between users.

SeaGo does not participate in:

• recruitment processes;
• employment negotiations;
• compensation arrangements;
• immigration or visa processes; or
• maritime placements or assignments.

Any employment, consulting, contractual, or commercial relationship entered into between users is entirely independent of SeaGo.

7. Acceptable Use

Users agree to use the Platform only for lawful purposes and in accordance with these Terms.

Users must not:

• upload unlawful, misleading, defamatory, abusive, or fraudulent content;
• interfere with operation or security of the Platform;
• attempt unauthorized access to systems or data;
• use automated scraping tools without authorization;
• upload malicious software or harmful files.

SeaGo reserves the right to investigate misuse and take action including suspension, removal of content, or termination of accounts.

8. Subscription, Billing, and Payment Terms

Certain Platform features may be offered on a paid subscription basis.

Where subscriptions are purchased through Apple App Store or Google Play, billing, renewals, cancellations, and refunds may also be subject to the applicable policies of those platforms.

Users acknowledge that:

• subscription fees may renew automatically unless cancelled;
• users are responsible for managing subscriptions through applicable app store settings;
• subscription fees are generally non-refundable unless required by law.

SeaGo reserves the right to revise subscription pricing, features, or availability upon reasonable notice.

9. Limitation of Liability and Disclaimers

To the maximum extent permitted by law, the Platform and services are provided on an “as is” and “as available” basis without warranties of any kind.

SeaGo does not warrant that:

• the Platform will operate uninterrupted or error-free;
• the Platform will be completely secure;
• User Content will be accurate or reliable;
• employment opportunities or commercial outcomes will result from use of the Platform.

SeaGo shall not be liable for:

• indirect or consequential losses;
• loss of profits, business, reputation, or opportunities;
• data loss or cybersecurity incidents;
• employment outcomes or hiring decisions;
• user misconduct or fraudulent activity.

Users acknowledge that use of the Platform and interaction with other users occurs entirely at their own risk.

10. Suspension and Termination

SeaGo reserves the right to suspend, restrict, or terminate access to the Platform where:

• users breach these Terms;
• unlawful or suspicious activity is identified;
• such action is necessary for legal, operational, or security purposes.

Termination shall not affect accrued rights or obligations existing prior to termination.

11. Intellectual Property Rights

All intellectual property rights relating to the Platform, including software, branding, logos, databases, design, and content, are owned by or licensed to SeaGo.

Users retain ownership of User Content but grant SeaGo a non-exclusive license to host, process, store, reproduce, and use such content solely for operation and improvement of the Platform.

12. Privacy and Data Protection

SeaGo processes personal data in accordance with the Privacy Policy and applicable data protection laws, including relevant UAE laws and, where applicable, GDPR principles.

Users acknowledge that sensitive personal data voluntarily uploaded through the Platform may be processed and stored in accordance with the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates.

The courts of Dubai, United Arab Emirates shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or use of the Platform.

14. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between SeaGo and users relating to use of the Platform.
